There are exceptions for self-developers (<em>autopromotores<\/em>), but only if the dwelling is not sold within the first ten years.<\/p>\n<ol>\n<li><strong> What Is the Seguro Decenal?<\/strong><\/li>\n<\/ol>\n<p>The <strong>Seguro Decenal<\/strong> is a ten-year warranty policy covering structural damage that could compromise the stability of the building.<\/p>\n<p>In the event of such damage, the insurance company assumes the costs of repair or compensation, even if the construction company no longer exists.<\/p>\n<ol start=\"2\">\n<li><strong> Is the Seguro Decenal Mandatory?<\/strong><\/li>\n<\/ol>\n<p>The insurance is legally mandatory in the following cases:<\/p>\n<ul>\n<li>For all new-build projects developed by a promoter and intended for sale.<\/li>\n<li>For dwellings sold to a third party within ten years of completion.<\/li>\n<\/ul>\n<p>Although the law allows exceptions for self-developers, it is always recommended to contract the insurance, since if the dwelling is sold within the ten-year period, the notary will require proof of coverage.<\/p>\n<p>Retroactive insurance is disproportionately expensive and is not always accepted in property transactions.<\/p>\n<ol start=\"3\">\n<li><strong> The Role of the OCT \u2013 Organismo de Control T\u00e9cnico (Technical Control Body)<\/strong><\/li>\n<\/ol>\n<p>The <strong>Seguro Decenal<\/strong> requires prior supervision of the works by an <strong>OCT \u2013 Organismo de Control T\u00e9cnico (Technical Control Body)<\/strong>, responsible for structural quality control.<\/p>\n<p><strong>Functions of the OCT:<\/strong><\/p>\n<ul>\n<li><strong>Before construction:<\/strong> review of structural drawings and the geotechnical report.<\/li>\n<li><strong>During construction:<\/strong> inspection of all works affecting the structure (foundations, slabs, load-bearing elements). Any deficiencies must be corrected before proceeding.<\/li>\n<li><strong>After completion:<\/strong> issue of a final report, which is an essential requirement for formalising the insurance policy.<\/li>\n<\/ul>\n<p>The OCT provides an additional guarantee of quality for both the developer and the buyer.<\/p>\n<ol start=\"4\">\n<li><strong> Why Is the Seguro Decenal Important?<\/strong><\/li>\n<\/ol>\n<ul>\n<li>Without it, a dwelling cannot be sold during the first ten years after completion.
